An officer from the Yorktown Police Department on patrol on Route 6 (East Main Street) conducted a traffic stop of Nicholas Horbatuk, 38, at approximately 2:38 a.m. on Wednesday morning after he was spotted unable to maintain his lane of traffic.
During the subsequent stop, police said that the officer determined that Horbatuk was driving while intoxicated and was in possession of an undisclosed amount of marijuana, and he was arrested at the scene and taken to police headquarters, where it was determined that his blood alcohol content was greater than .08 percent.
Horbatuk was charged with misdemeanor counts of driving while intoxicated and driving while intoxicated with a blood alcohol content greater than .08 percent. He was also cited for unlawful possession of marijuana, a violation, and multiple traffic infractions. Horbatuk was released on his own recognizance following arraignment and he is due back in Yorktown Justice Court on May 3 to answer the charges.
